Ruling. This matter is continued to June 25, 2026, at 9:00 a.m. Petitioner is ordered to: 1. Lodge the Decedent’s original will with the Marin Superior Court. (Prob. Code, § 8200.)
2. File a Supplement to Petition that provides the following information: a. Decedent’s Date of Death. The Petition alleges that Decedent died on 4/16/1939. This appears to be incorrect due to the execution of Decedent’s Trust in 2005. b. Attorney-in-Fact. i. Why is Petitioner’s attorney-in-fact under her Power of Attorney listed in Item 8’ ii. Was this Petition brought by Petitioner herself or by the attorney-in-fact’ iii. If by the attorney-in-fact, what is the legal authority for this’ c. Notice. (Prob. Code, § 1208(b).): i. Who is the Trustee of the Morse Family Trust’ ii. If Petitioner is the sole Trustee, who are the beneficiaries, and did they receive proper notice’ iii. If Petitioner is not the Trustee, did Trustee receive proper notice?
3. If additional notice is required, file Proof of Service confirming that the parties named above receive proper notice on the mandatory form “Notice of Petition to Administer Estate.” (Judicial Council Forms, form DE-121; Prob. Code, § 8110.)
4. All documents must be filed or submitted at least five court days prior to hearing. (Super. Ct. Marin County, Local Rules, rule 6.2(b), Filing, Hearing, and Continuance Procedures.)
