Set for Law and Motion/Discovery Calendar on Wednesday, May 27, 2026, Line 1. Defendants Stephen Henry and Raymond Bell's MOTION TO CONSOLIDATE ACTIONS OF CASE(S) CGC-25-628460 WITH CASE CGC-23-610334 is DENIED WITHOUT PREUDICE.
Defendants represent the following: "Additionally, this motion is made timely and brought without delay, as litigation on the two civil matters has just begun." (Defs' MPA at p. 2.) Not mentioned is that trial in CGC-23-610334 is set for June 22, 2026-less than four weeks from this hearing date. If consolidated for all purposes as requested, all dates in CGC-23-610334 would apply to both actions, meaning both actions would be set for trial in less than four weeks. Absent an express acknowledgement from all parties in CGC-25-628460 that they will be ready for trial on June 22, 2026, the court will not impose trial upon them at such a late date (especially since this motion could have been made a year and a half ago).
Defendants' ask the court to simply move the trial date in CGC-23-610334. The master calendar department, not this department, manages the trial calendar. Defendants may renew their motion if they secure a trial continuance in CGC-23-610334 from Department 206. Moving Defendants are ordered to prepare a proposed order quoting the above verbatim and email it to contestdept302tr@sftc.org prior to the time set for this hearing.
