Plaintiff's Motion for Entry of Judgment for Possession and Monetary Damages Pursuant to Stipulation is OFF CALENDAR. There is no proof of service on file showing that the moving papers were served on the defendant before the original hearing date on this motion. Per CRC 3.1300(c), proof of service of the moving papers must be filed no later than five court days before the time appointed for the hearing. Despite this rule, this motion has already been continued once to allow for consideration of plaintiff's late filings. However, the requisite proof of service is still not on file. The declaration stating that defendant was informed of the original hearing date by phone and email is insufficient.
