No proof of service on Defendant Berti, who is not represented in this action. Although the proof of service executed by Plaintiff's counsel's staff indicates the moving papers were dispatched for hand delivery addressed collectively to both defendants, there is no proof of service by any person who actually delivered said papers, to anyone. Defendant Berti, who is self-represented, must be served moving papers separately from any other party. (CRC 1.21.)
The Court notes that the Stipulation for Entry of Judgment, entered into by all parties including Defendant Berti, creates ambiguity regarding how Defendant Berti is situated in this action, as the clerk of the Court entered default of Defendant Berti on July 18, 2025 at Plaintiff's request. Accordingly, any future attempt to enforce the Stipulation will need to address this issue, with citation to appropriate authorities. =(501/CFH)
