Defendants' Motion for Summary Judgment, or in the Alternative, Summary Adjudication is GRANTED. The seven-year statute of repose and res judicata bar Plaintiff's causes of action. It is undisputed that the underlying transfers occurred more than seven years before the filing of the Complaint in this case. The purported overt acts taken in furtherance of the conspiracy do not create triable issues of fact because there is no fraudulent transfer cause of action to which the conspiracy can attach, and the statute of repose extinguishes any cause of action that has not been filed "within seven years after the transfer was made" no matter whether the claim is "brought under the UFTA or otherwise."
