Moving party failed to shift its burden. The Court notes that defendant only moved for summary judgment, not for summary adjudication. Separate Statement appears to repeat the same 10 facts 10 times. Motion is supported only by declaration of Brain Mi. Paragraph 4 of Mi declaration lacks foundation. This paragraph is listed as the sole source of evidence of Fact 5. No evidence whatsoever is provided by the moving party that the fire was not caused by Mi's "family, invitees, and guests." Furthermore, there is a triable issue of fact regarding the responsible party for the damages caused by fire in the leased unit. =(501/SKF)
