No competent evidence provided that Defendant remains in possession "as of the date of this motion." See Separate Statement, fact 11. The motion deeming admissions admitted was granted on July 27, 2026, a month before this motion was filed. Becerra Declaration, paragraph 7 does not contain any evidence as to possession. To the extent Plaintiff erroneously listed paragraph 7, as supporting evidence for fact 11, and it should have referenced to paragraph 6 (the only paragraph of Becerra declaration addressing possession), that paragraphs does not contain competent admissible evidence.
