DEFENDANTS' MOTION TO VACATE JUDGMENT This matter will be heard at 1:30 p.m. on October 15, 2025 in department 505 by the Honorable Michelle Tong.
Defendants' Motion to Vacate Judgment is DENIED. The Defendants have not shown that the judgment was the result of any mistake, inadvertence, surprise, or excusable neglect. The Notices of Violation are not material to this unlawful detainer action, and therefore would not have changed the outcome of Plaintiffs' Motion for Summary Judgment, because this action is not based on nonpayment of rent. The Notices of Violation were also issued after Plaintiffs' Motion for Summary Judgment was already heard and granted, and have no bearing on this action based on a Notice to Cure or Quit served several months prior.
The Defendants have also failed to show that the judgment is based on any incorrect or erroneous legal basis for the decision, or was not consistent with or not supported by the facts. The Order Granting Plaintiffs' Motion for Summary Judgment, filed September 3, 2025, explains the legal and factual basis for the Court's decision. =(501/MT)
