Defendants' Motion for Summary Judgment is GRANTED. Defendants have shifted their burden by showing that the 30 Day Notice to Pay Rent or Quit does not comply with the requirement of CCP 1161(2) to provide the address of the person to whom rent payment is to be made, in the event the payment is made personally as permitted by the Notice. Since the language of the Notice is undisputed, plaintiff cannot show that there is any triable issue of material fact.
This matter will be heard in department 505 by the Honorable Michelle Tong at 1:30 p.m. per the order of the presiding judge. =(505/MT) Parties may appear in-person, telephonically or via Zoom [Webinar ID: 160 4132 4666; Password: 872834; Phone Dial in: (669) 254-5252].
Parties who intend to appear at the hearing must give notice to opposing parties and the court promptly, but no later than 4:00 p.m. the court day before the hearing unless the tentative ruling has specified that a hearing is required. Notice of contesting a tentative ruling shall be provided by sending an email to the court to Department501ContestTR@sftc.org with a copy to all other parties stating, without argument, the portion(s) of the tentative ruling that the party contests. A party may not argue at the hearing if the opposing party is not so notified and the opposing party does not appear. | |
