PLAINTIFF HCL PINNACLE HOLDINGS, LLC MOTION FOR SUMMARY JUDGMENT is DENIED.
Plaintiff has failed to show that it is entitled to judgment as a matter of law based on the undisputed facts. According to Plaintiff's undisputed facts and supporting evidence, there is at least one person not named as a defendant in this action, who is in actual occupation of the premises and whose name was known to Plaintiff when the Complaint was filed. Such person is therefore a necessary party to this unlawful detainer action, but has not been named. (CCP 1164.) =(501/CFH)
