PARTY: Defendant Ford Motor Company Motion to Compel Further Responses to Requests for Production The court considered the moving, opposition, and reply papers filed in connection with this motion. DISCUSSION Plaintiff Francisco Estrada ("Plaintiff") moves the court for an order compelling Defendant Ford Motor Company ("Defendant") to serve further responses to Requests for Production Nos. 10, 17, 31, 37-75, and 81-82. The court grants Plaintiff's motion to compel further responses to Request Nos. 10, 17, 81, and 82 because (1) the statements of compliance with the demands are incomplete, and (2) the objections in the responses are without merit. (Code Civ.
Proc., Sec. 2031.310, subd. (a)(1)(3).) The court grants Plaintiff's motion to compel further response to Request No. 31 because the objections in the response are without merit. (Code Civ. Proc., Sec. 2031.310, subd. (a)(3).) The court grants in part Plaintiff's motion to compel further responses to Request Nos. 38, 41, 44, 47, 50, 53, 56, 59, 62, 65, 68, 71, and 74, limited to the time period from November 16, 2021 to November 16, 2025, because the objections in the response are without merit. (Code Civ.
Proc., Sec. 2031.310, subd. (a)(3).) The court denies Plaintiff's motion to compel further responses to Request Nos. 37, 39, 40, 42, 43, 45, 46, 48, 49, 51, 52, 54, 55, 57, 58, 60, 61, 63, 66, 67, 69, 70, 72, 73, and 75 because they are (1) overbroad since they would include documents that are not relevant to the subject matter involved in this action and are not reasonably calculated to lead to the discovery of admissible evidence, and (2) unduly burdensome. (Code Civ. Proc., Sec. 2017.010.) ORDER The court grants plaintiff Francisco Estrada's motion to compel further responses to requests for production of documents in part as follows.
Pursuant to Code of Civil Procedure section 2031.310, the court orders defendant Ford Motor Company (1) to serve on plaintiff Francisco Estrada further written responses, without objections and which comply with Code of Civil Procedure sections 2031.210-2031.250, to plaintiff Francisco Estrada's Requests for Production of Documents, Nos. 10, 17, 31, 81, and 82, and Nos. 38, 41, 44, 47, 50, 53, 56, 59, 62, 65, 68, 71, and 74 (limited to the time period from November 16, 2021 to November 16, 2025) and (2) to produce to plaintiff Francisco Estrada all documents and things in defendant Ford Motor Company's possession, custody, or control which are responsive to those requests, within 30 days of the date of service of this order.
The court orders plaintiff Francisco Estrada to give notice of this order. IT IS SO ORDERED.
