Motion for Summary Judgment is DENIED. Triable issues of fact exists regarding the approval of defendant's subtenancy.
Motion for summary adjudication of affirmative defenses is DENIED. According to the notice of motion Plaintiff moves the Court for determination that the Defendant cannot "prove" the affirmative defense. This is not supported by Points and Authorities, which contain an argument that Defendant failed to properly plead affirmative defenses. Additionally, Plaintiff fails to cite any authority for the proposition that an affirmative defense expressly addressing the amount of damages sought in the complaint may be disposed of due to Plaintiff waiving a claim for monetary damages for the purposes of seeking summary judgment or summary adjudication of Plaintiff's cause of action as to possession. =(501/CFH)
