Plaintiffs' ex parte application for an order advancing the date on Plaintiffs' Motions for Summary Adjudication of Defendants' Affirmative Defenses ("MSAs") alternatively requests: (1) Advancing the Hearing Dates on twenty-four (24) MSAs to August 13, 2026; or (2) permitting the MSAs to be heard at any time up to the time of trial. (App. at 2-3).
Plaintiffs' first request to advance the hearings for 24 MSAs to August 13 is DENIED. The court lacks capacity to hear 24 MSAs on a single calendar. Additionally, 22 motions including 9 Motions for Summary Judgment/Summary Adjudication have already been scheduled for this date.
Plaintiffs' alternative request is GRANTED. All 24 of the MSAs were noticed for hearing after the current August 24, 2026 trial date, and 3 of the motions were noticed on Wednesday, September 2, a Wednesday which is not available for law & motion hearings in asbestos matters. To accommodate the grant of Plaintiffs' request, the court finds good cause to continue the trial pursuant to section 36(f) of the Code of Civil Procedure and orders as follows:
The Jury Trial scheduled for 08/24/2026 is continued to 09/08/2026 at 10:00 AM in Department 18 at Rene C. Davidson Courthouse.
The Hearing on Motion for Summary Adjudication filed by JOVY MENOR (Plaintiff) + CRS# 210385959596 scheduled for 09/02/2026, the Hearing on Motion for Summary Adjudication filed by JOVY MENOR (Plaintiff) + CRS# 302632222403 scheduled for 09/02/2026, and the Hearing on Motion for Summary Adjudication filed by JOVY MENOR (Plaintiff) + CRS# 868587333623 scheduled for 09/02/2026 are continued to 09/08/2026 at 10:00 AM in Department 18 at Rene C. Davidson Courthouse.
All other of Plaintiffs' MSAs shall remain on calendar as noticed.
Plaintiffs' counsel must forthwith serve a copy of this order on all counsel of record and selfrepresented parties. The Court orders counsel to obtain a copy of this order from the eCourt portal.
CONTESTING THE TENTATIVE RULING: If the parties do not contest the tentative ruling, it will be adopted. Any party wishing to contest the tentative ruling must notify the court by email at Dept18@alameda.courts.ca.gov, and notify all opposing counsel or unrepresented parties by 4pm the day before the hearing.
