MOTION TO SET ASIDE AND VACATE DEFAULT JUDGMENT; DISMISSING WITH PREJUDICE [C.C.P. §473]
TENTATIVE RULING:
Plaintiff’s unopposed motion is GRANTED. The default and default judgment entered on December 21, 2021 are vacated. Plaintiff shall file a request for dismissal within five days after notice of entry of order. The court is ordered to vacate the default and default judgment immediately. The court sets a Order to Show Cause re Dismissal in Department 4 on July 28, 2026 at 9:30 a.m. If the dismissal is filed before then, and it should be filed before then, then no appearance is necessary.
If the tentative ruling is uncontested, it shall become the order of the court. Thereafter, counsel for plaintiff shall prepare a written order consistent with the court’s ruling for the court’s signature, pursuant to California Rules of Court, rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
