Tentative Ruling
On the Court's own motion, the Case Management Conference - Case Management Program scheduled for 10/04/2024 is continued to 10/11/2024 at 8:30 AM in Department 38 at Gordon D. Schaber Superior Court.
The Court notes that the Complaint was filed on April 20, 2021. The Complaint names as defendants Rebecca Diane Hill, Campoy Hill, Jacklin Tibbetts, and Does 1 to 25. Pursuant to a settlement, Plaintiff has dismissed defendant Jacklin Tibbets. (See Request for Dismissal, filed 5/31/2022.) On July 22, 2021, Rebecca Campoy Hill filed an answer, indicating she was erroneously sued as Campoy Hill. Plaintiff has not addressed the defendant whom plaintiff sued in the name Rebecca Diane Hill. Plaintiff should inform the Court whether that is someone other than Rebecca Campoy Hill.
The Court also notes that plaintiff has not identified or served Does 1-25. CCP section 583.210(a) requires that plaintiff serve defendants within three years after commencement of an action. More than three years have passed. Accordingly, plaintiff should inform the Court whether the Doe defendants can be dismissed and, if not, why not. The Court anticipates that, if the Doe defendants are dismissed and plaintiff clarifies that the only remaining defendant is Rebecca Campoy Hill, the action will be at issue and can be referred to the Courts trial setting process.
Plaintiffs counsel is ordered to appear (by Zoom) at the October 11, 2024, case management conference. Plaintiffs counsel should be prepared to address the matters discussed above.
