Motions: 1) Plaintiffs Motion to Quash Defendants School Records Subpoenas (opposed) 2) Plaintiffs Motion to Quash Defendants School Records Subpoena to Simi Valley Unified School District, request for sanctions of $2,760 (opposed) Tentative Rulings:
The Court GRANTS Plaintiffs two Motions to Quash in part, limiting each of the subpoenas requests to official and unofficial transcripts for high school years, a copy of the relevant work permit, and any records specifically from the work-experience class, (i.e., weekly reports submitted to the supervising teacher). The parties shall meet and confer regarding an appropriate protective order, to be drafted by the parties.
In balancing Plaintiffs privacy interests in her school records against the Defendants need for the discovery, the Court considers the practical consequences of the requested disclosure of Plaintiffs records, which is relatively modest. Any intrusion on Plaintiffs privacy rights is minimal, particularly if records are produced subject to a protective order. At the same time, Defendants stated need for the bulk of the discovery requested is non-existent or not particularly compelling. The limitations set forth above strike an appropriate balance.
The Court denies sanctions given the mixed result.
