The Motion to Compel DEFENDANT PENDLETON PARTNERS, LPS NOTICE OF MOTION AND MOTION TO COMPEL THE DEPOSITION OF NON-PARTY ANTHONY BLANCO AND FOR SANCTIONS filed by PENDLETON PARTNERS, LP on 01/13/2026 is Granted in Part.
The unopposed Motion of Defendant Pendleton Partners, LP (Defendant) to Compel Deposition as to Anthony Blanco is GRANTED IN PART. (Code Civ. Proc. § 2025.450, subd. (a).) At the time of this Order, no Opposition has been filed. Plaintiff Andy Les Joinder to the Motion is granted. Monetary sanctions in the amount requested of $3,752.05 are awarded in the reduced amount of $800 against Mr. Blanco, payable to Defendant forthwith. (Baer Decl, ¶ 15.) Mr. Blanco is ordered to appear at a properly noticed deposition pursuant to Code of Civil Procedure section 2025.220 on a date of Plaintiffs counsels choice, given that he is provided with at least ten (10) calendar days notice. (Code Civ.
Proc., § 2025.270, subd. (a).) Mr. Blanco shall also produce documents in all categories for all requests as identified in the deposition notice at least two (2) business days prior to the noticed deposition. DISCUSSION On November 4, 2025, Defendant properly subpoenaed Mr. Blanco by personal service for a deposition and has shown good cause for taking his deposition since he was identified by Plaintiff as a security guard witness to the subject incident central to this litigation. (Baer Decl. ¶¶ 5-7; Exs.
A, C.) Six days prior to the deposition, Defendant attempted to confirm Mr. Blancos attendance by mail but failed to receive a response. (Id. at ¶¶ 9-10, Ex. E.) Defendants counsel additionally called Mr. Blanco on December 17, 2025, the date of the deposition, and spoke to him; as Mr. Blanco was apparently working, Mr. Blanco promised to call back but failed to do so. (Id. at ¶¶ 12-13.) Mr. Blanco has since failed to respond to further attempts to call him. (Ibid.) NOTICE TO BLANCO: Anthony Blanco is advised that failure to comply with this Order may result in the imposition of future sanctions, including evidentiary, monetary, or terminating sanctions.
