Defendant Fernandez Tree Service's motion for terminating sanctions against plaintiff Julio Joaquin Ramos Jr. is granted. The motion is unopposed.
Defendant presents evidence that it served discovery on Ramos, Ramos did not respond, Defendant obtained orders compelling responses in September 2024 and requiring sanctions, and Ramos has not complied with the orders. Terminating sanctions are a harsh remedy, but Defendant is entitled to know the basis for Ramos's claims and the facts and evidence in support of them. Ramos did not oppose this motion and did not oppose the September 2024 motions to compel. It appears to the court that Ramos has abandoned his claims and that lesser discovery remedies will not bring Ramos into compliance with his discovery obligations.
Accordingly, after consideration of the range of sanctions available, terminating sanctions are granted and the Ramos's claims against Fernandez Tree Service are dismissed.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
