PLAINTIFF DIANA ZUNIGA's Motion To Compel Compliance With Response To Request For Production Of Documents, Set One From Carmen A. Gonzalez And Request For Monetary Sanctions In The Amount Of $3,001.50.
The unopposed motion by plaintiff and cross-defendant Diana Zuniga to compel production consistent with defendant and cross-complainant Carmen A. Gonzalez's responses to her requests for production of documents, set one, is granted as stated herein with sanctions.
The July 8 email from Kim Descamps (Ex. E to Descamps Decl.) represents that certain documents were discussed at Gonzalez's deposition, and the responding email by Elizabeth Erhardt represents that they will be produced. Zuniga also provides deposition testimony from Gonzalez concerning the documents. (Ex. D to Decamps Decl.)
Gonzalez is ordered to produce those documents as well as any others she has agreed to produce but has not yet produced, within 10 court days of entry of this order. If Gonzalez contends that she no longer has them in her possession, custody, or control, she shall provide a verified statement describing her search and her representation that she no longer has them in her possession, custody, or control, as well as the information required by Code of Civil Procedure, section 2031.230.
Zuniga seeks sanctions. Sanctions are appropriate on a discovery motion where the objecting party does not act with substantial justification in its discovery compliance, even where she does not oppose the motion. (See Code Civ. Proc., section 2031.320, subd. (b); Rule of Court 3.1348(a).) The court does not find that Gonzalez acted with substantial justification and orders Gonzalez to pay sanctions of $3,001.50 within 30 days of entry of this order.
