Plaintiffs Motion for Terminating, Evidence, and Monetary Sanctions against Defendants Clemente Rodriguez, Teresa Rodriguez, and CR Construction LLC is GRANTED, for the reasons set forth in the moving papers.
Defendants request that the motion be denied because it was served one day later than required by the Code of Civil Procedure is DENIED. This motion was continued from its prior hearing date of July 13 to July 27. Defense counsel was served with this motion 41 days before the continued hearing date and he demonstrates no prejudice from the one day delay in service of the motion.
Defendants Answer to Plaintiffs Complaint is STRICKEN.
Sanctions of $610 are awarded to Plaintiff Jose Caldera against Defendants, jointly and severally (but not against defense counsel.) This is in addition to the previously awarded sanctions.
