PLAINTIFF THE JOHN STEWART COMPANY DEMURRER to ANSWER to Amended COMPLAINT is SUSTAINED with leave to amend. Leave to amend requested in the declaration of Shelton Simpson. Mackenzie Tucher and Isabella Tucker filed no written response to the demurrer.
The Corut notes that Simpson declaration refers discovery in paragraph 5, not an issue before the Court on a demurrer. In light of this reference to the discovery, it is unclear which "motion" defendant claims to not have received a notice of hearing of.
