BRYAN ANGELO MCGILL ET AL | Court Date: | | 2025-08-12 09:30 AM | Calendar Matter: | | Notice Of Motion And Motion To Set Aside Judgment | Rulings: | | Real Property/Housing Court Motion calendar for August 12, 2025, line 8.
Defendants' Motion to Set Aside Judgment is GRANTED, on the sole basis that the July 21, 2025 Order granting plaintiffs' motion for summary judgment does not comply with CCP 437c(g). The Court, on its own motion, sets aside the entry of this Order pursuant to CCP 473(d), on the grounds that the Order which does not comply with CCP 437c(g) was entered due to a clerical error.
Accordingly, the judgment is vacated and the writ of possession is recalled. Plaintiffs must re-submit a proposed order in compliance with both CCP 437c(g) and CRC 3.1312. Nothing in this ruling shall affect the Court's substantive ruling granting the motion for summary judgment. =(501/SKF)
