Plaintiff's Motion for Summary Judgment is DENIED. Plaintiff has not shifted the burden on the issue of breach. Plaintiff's evidence of breach is one declaration with conclusory statements that the Defendants "refused" to sign a lease, sell a business, lease a property, and honor a right of first refusal.
