Plaintiff's Motion for Attorney's Fees is GRANTED in part. Plaintiff is awarded attorney's fees and costs in the amount of $44,523.77.

The Court excluded the following costs from the award: (i) Costs incurred from July 30, 2024 to August 20, 2025 as these tasks related to the Trust matter; (ii) costs associated with the Motion to Vacate; (iii) a $12.00 "toll expense" on June 18, 2024. (See, Exhibit A, pgs. 7-8, 19 [April 9, 14, June 18, 2024 billing record].)

The Court finds the costs associated with the motion to vacate did not provide a common benefit to all parties. (See, CCP sections 874.010, 874.040.) Likewise, there are no tasks in the billing records or hearings on calendar that correspond with the June 18, 2024 toll expense. These expenses shall be borne by the Plaintiff.

Plaintiff's request that the Court allocate 100% of the fees and costs to Defendant's share of the proceeds is denied. =(501/CFH)
