MOTION FOR APPROVAL OF REPORT OF REFEREE AND REFEREE'S RECOMMENDATIONS, FOR INSTRUCTIONS TO THE REFEREE, TO COMPEL DEFENDANT TO COMPLETE TAX FORMS AND FOR APPROVAL OF REFEREE FEES AND COSTS is GRANTED. The Report of Referee is approved and allowed in all respects as filed. The rent proceeds in the amount of $117,360.78 are determined to be part of the partition estate and shall be allocated in accordance with the Referee's recommendation. The expenses of sale and partition shall be allocated to each party according to their respective ownership interest.
Referee is instructed to pay Defendant's court-ordered attorney's fees in the amount of $17,549.11. The Court orders Defendant to complete and return all tax forms to Chicago Title Company within five days of this court's order. The Court approves payment of Referee's fees in the amount of $12,155 and costs in the amount of $11.85. =(501/CFH)
