On August 28, 2026 the Court issued a tentative ruling requesting a supplemental declaration and a supplemental brief.

A. The supplemental declaration of Erin Ford was to address the claim made in the declaration submitted on August 7, 2026 that the Court adopted all tentative rulings on the discovery motions heard in Department 301 on the same date. The Court's minutes available of the Court's web-site indicate that the Defendant's Motion to Compel Plaintiff Maya Blyth's Appearance, Testimony, and Production of Document at Deposition was taken under submission. This was contrary to the declaration of Erin Ford as to the outcome of all hearings on August 7, 2026. The Court asked Ms. Ford to submit evidence to support her assertion in support of her statement. In response, Ms. Ford stated that the minutes for that specific motion were not available and that the transcript for the hearing could not be obtained by the deadline.

The Court checked, the minutes are on the Court's web-site and the Court listened to the transcript of the hearing, which reflects the following: "THE COURT...The next motion is at 9 in my internal numbering. This is the motion to compel Plaintiff, Maya Blyth's, appearance, testimony, and production of documents at deposition. I am taking that under submission. For transparency, I'm likely only to just make clearer that I'm?? nothing in the order requires production of privileged or work product documents, but that is under submission." Both the minutes and the transcript show that the motion was taken under submission on Friday, August 7, 2026.

On August 7, 2026, Department 501 checked the outcomes of the discovery motion, specifically the motion to compel deposition (which was one of the motions discussed at length at the August 6, 2026 ex-parte hearing), the motion was listed as "under submission" in the published minutes.

By the time department 501 checked for an order on the Motion to Compel Deposition, on Monday, August 10, 2026, Defendants have already filed an opposition to the Motion for Summary Adjudication accompanied by a declaration of Erin Ford stating: "9. I did not state an appearance at this morning's hearing but was listening in as an observer. Following argument, all of the tentative rulings on defendant's motions were adopted with the exception that one order is being modified to reflect that plaintiff does not have to produce privileged documents, since the tentative did not specify. Proposed orders have been submitted but have not yet been executed by Department 301. Under the tentative rulings being adopted, Plaintiff has until August 28, 2026 to present for deposition and produce documents."
