B. The supplemental brief was to provide information necessary for the Court to determine if the renewed request for a continuance of the Motion for Summary Adjudication per CCP 437c(h) is to be granted. The Court specifically asked, inter alia, that the defendant (1) list elements of each affirmative defense; and (2) facts and evidence supporting each defense.

Defendant provided elements of each defense and for each defense a long list of evidence without any indication as to which element of the particular defense that evidence was in support of. Therefore, no later than 8:00 a.m. on September 2, 2026 Defendant to provide the required information, specifically listing the facts/evidence in conjunction with each element. For example, Defendant may present this information in a Table Format. Title of the Table: Third Affirmative Defense: Statutes of Limitations.

Column 1: Elements listed in the supplemental brief (1) the statute governing the particular cause of action; (2) the date the claim accrued; (3) expiration of the statutory period before the complaint was filed; and (4) the absence or inapplicability of delayed discovery, tolling, continuing-violation, continuous-accrual, estoppel, or another exception. Column 2: Facts/evidence form the bullet-point list at 13:11-14:19 of the Supplemental Brief.

The Court will issue an updated tentative ruling upon the review of the supplemental brief on September 2, 2026 before the hearing. =(501/CFH)
