No later than August 31, 2026 by 4:00 p.m. Erin Ford to file a supplemental declaration attaching a copy of August 7, 2026 minutes reflecting that the tentative ruling on the Motion to Compel Plaintiff's Appearance, Testimony, and Productions of Documents at Deposition, was adopted (See paragraphs 9 of Ford Declaration) or a copy of the hearing transcript showing the same. Relevant parts of the transcript highlighted. The Court is not requesting copies of the minutes or transcript for any other motions heard on that date.

No later than August 31, 2026 by 4:00 p.m. Defendant to file a supplemental brief including the requested date for a continued hearing, the requested date of opposition filing and the requested date of reply. The supplemental brief shall also include the following for each of the 17 affirmative defenses: (1) title of the defense as it appears in the operative answer; (2) the text of the allegations in the defense; (3) elements of each defense; (4) facts supporting each element of each defense; (5) evidence supporting each fact; (6) the source of the evidence, either (a) Defendant's testimony on January 6, 2026 and May 7, 2026; or (b) any discovery obtained from Plaintiff/third parties between August 7, 2026 and August 28, 2026; (7) attach evidence with parts referenced in item (6)(a) or (6)(b) highlighted and tabbed; (8) if there are no facts and no evidence in support of any of the elements of any of the affirmative defenses, Defendant shall clearly state "none," and, if applicable, state the specific discovery needed to obtain those facts, the date the discovery will be obtained (e.g. deposition of Jane Doe scheduled for September 7, 2026).

Based on this response the Court will rule on the request to continue the hearing pursuant to CCP 437c(h). =(501/CFH)

Parties who intend to appear at the hearing must give notice to opposing parties and the court promptly, but no later than 4:00 p.m. the court day before the hearing unless the tentative ruling has specified that a hearing is required.

Notice of contesting a tentative ruling shall be provided by sending an email to the court to Department501ContestTR@sftc.org with a copy to all other parties stating, without argument, the portion(s) of the tentative ruling that the party contests. A party may not argue at the hearing if the opposing party is not so notified, and the opposing party does not appear. | |
