The motion of Defendant Cerner Corporation (“Defendant”) to continue trial is unopposed and GRANTED.

Trial is currently scheduled for June 22, 2026. Defendant requests a continuance of trial on grounds Defendant was not added to the action until 19 months after it commenced and has not had a sufficient opportunity to complete discovery and file a dispositive motion, and because multiple counsel have conflicts with the trial date. Defendant proposes November 3, 2026 as the new trial date and represents all other defendants have agreed to the continuance. Plaintiff filed a response indicating Plaintiff intends to add additional parties and agreeing to the proposed continuance.

The Court finds good cause for a continuance based on the foregoing and the factors set forth in California Rules of Court, rule 3.1332. The May 13, 2026 MSC and the June 22, 2026 trial dates are VACATED.

Trial is scheduled for November 3, 2026 at 8:30 a.m. in Department 47. A mandatory settlement conference is scheduled for October 2, 2026 at 9:30 a.m. in Department 59. All statutory deadlines, including discovery and expert discovery, shall be governed by the new trial date.

This case has been assigned to Department 47 for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 47. Any party requesting an oral

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government Code section 68086 and California Rules of Court, rule 2.956. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporter’s Office and an official reporter will be provided.
