TENTATIVE RULING:
The Notice of Motion fails to provide notice of the Courts tentative ruling system for the Law and Motion calendar in the Presiding Judges Department. (See Local Rule 1.05(C)-(D).) In pertinent part, Local Rule 1.05 provides that all noticed motions in the Presiding Judges Department shall include the following language in the notice:
Pursuant to Local Rule 1.05, the Court will make a tentative ruling on the merits of this matter by 2:00 p.m., two court days before the hearing. The complete text of the tentative ruling may be accessed on the public portal. If the party does not have online access, they may call the dedicated phone number for the department as referenced in the local telephone directory and receive the tentative ruling. If you do not call the Court and the opposing party by 12:00 p.m. the court day before the hearing, no hearing will be held.
Moving counsel is directed to contact opposing counsel and/or self-represented litigants to advise them of Local Rule 1.05, the Courts tentative ruling procedure for motions noticed in the Presiding Judges Department, and the manner to request a hearing. If counsel is unable to contact opposing parties prior to the hearing, they are ordered to appear at the hearing by Zoom or by telephone.

Defendants Rachandeep Singh, M.D. and Access Physician Inc.s (Defendants) motion to continue trial is unopposed and is GRANTED, as detailed herein.
The complaint was filed on August 22, 2023, and Plaintiff alleges causes of action for assault, sexual battery, battery, intentional infliction of emotional distress, sexual harassment, and sex discrimination. Plaintiff alleges that Defendant Singh engaged in the complained of actions during a medical examination for abdominal complaints. On August 16, 2023, a criminal complaint was filed against Defendant Singh, regarding the same alleged actions.
An MSC is set in this matter for September 9, 2026, with trial set for October 20, 2026. On July 17, 2026, trial was set for January 11, 2027 in Defendant Singhs criminal proceeding. Defendants argue that trial of this matter must be continued to a date beyond the criminal trial date, to preserve Defendant Singhs Fifth Amendment privilege against self-incrimination.
The Court finds good cause for the requested continuance, pursuant to Rules of Court, rule 3.1332. Defendant Singh would be substantially prejudiced if this matter were to proceed to trial prior to the related criminal proceeding. The MSC and Trial dates are VACATED.
The parties failed to comply with Local Rule 2.11, which requires all counsel to provide their availability for the 90-day period following the current trial date, regardless of whether the motion is opposed. As a result, the Court is unable to select a date for trial that will not result in a potential conflict. Therefore, the Court will instead refer this matter to the Trial Setting Process.
This case is referred to the Trial Setting Process for selection of trial and mandatory settlement conference (MSC) dates. All counsel (including parties appearing in pro per) shall confer and agree upon three (3) trial and three (3) MSC dates. Available dates can be obtained on the Courts web site at https://services.saccourt.ca.gov/PublicCourtApplications/Civil/TrialSettingProcess/. Plaintiff shall promptly utilize the online submission form on the above website to submit the parties preferred dates to the Court. The Court will review the submitted dates and from those, select one MSC and one trial date. The Court will provide email confirmation of the confirmed dates to the party that submitted the online form.
If the parties have not agreed on dates and/or otherwise fail to submit their agreed upon dates to the Court on or before the 60th day after the date of the Courts referral order, court staff shall assign MSC and trial dates that are next available, unless an extension of time has been granted

by the appropriate Civil Home Court Department.
Upon receiving email confirmation from the Court confirming the calendared MSC and trial dates, Plaintiff shall file and serve notice of such dates, times, and departments to all parties. The Court will provide notice to the parties only in the instance where the Court has selected dates due to the failure of the parties to submit their preferred dates in a timely manner.
This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc., § 1019.5; CRC 3.1312.)
*** This case has been assigned to Department 17A for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 17A. Any party requesting an oral argument must contact the clerk at (916) 874-5487 and opposing counsel or parties in pro per by 12:00 p.m. on the court day before the hearing. If a proper request for hearing is not made, this shall become the order of the Court.
Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government Code section 68086 and California Rules of Court, rule 2.956. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided. ***
