DEFENDANT DARLENE CURRY (SUED AS DOES 1 TO 15), CHARVEL AUGUSTINE DEMURRER to Amended COMPLAINT; is OVERRULED, 5 days to answer.
The First Amended Complaint states a cause of action for unlawful detainer and is not uncertain. Nothing on the face of the First Amended Complaint supports an inference that Defendants Darlene Curry and Charvel Maurice Augustine Jr., who were originally sued as Does and are not alleged to be parties to the Occupancy Agreement, are the qualified tenants who were the beneficiaries of the government contract and are thus entitled to 90 days' notice of its termination under Civil Code 1954.535.
Regarding Defendants' uncertainty arguments, the allegations are not so uncertain that Defendants cannot reasonably respond. =(501/CFH)

Notice of contesting a tentative ruling shall be provided by sending an email to the court to Department501ContestTR@sftc.org with a copy to all other parties stating, without argument, the portion(s) of the tentative ruling that the party contests. A party may not argue at the hearing if the opposing party is not notified, and the opposing party does not appear. | |
