DEFENDANT DAVID PILPEL DEMURRER to COMPLAINT is OVERRULED, 5 days to answer from notice of entry of order. The Complaint states a cause of action and is not uncertain. Further, the Complaint is not founded upon a contract, as it expressly alleges that Defendant was permitted to occupy the premises as a guest without any payment of rent in exchange. Finally, the Code of Civil Procedure specifically contemplates termination of license as a cognizable basis for an unlawful detainer action. To whatever extent Defendant disputes the allegations of the Complaint, or seeks to raise facts outside of those alleged in the Complaint, these cannot be considered on demurrer; rather, such disputes and additional facts are appropriate for inclusion in an answer. =(501/CFH)
