Gary Epis, as Trustee of the Barbara Jenkins 2000 Trust Dated May 25, 200 restated October 30, 2018 is already a plaintiff in this action. No authority is cited for the proposition that a substitution into the case is appropriate under the circumstances, effectively having the same "person" being a plaintiff twice in the same exact capacity.
To the extent, Epis, as Trustee wishes to explain how the Trust came into "possession" of additional claims that previously belonged to the decedent, and not are the assets of the Trust, Mr. Epis, as Trustee, may file a motion to file an amendment to complaint. =(501/CFH)
