Plaintiff and counsel are ORDRED to personally appear, either in person or remotely via Zoom, to address issues relating to representation, case status, and future proceedings. Failure to appear may result in appropriate sanctions or other orders.

The unopposed motion of attorneys Randy Katz and Elizabeth Evans of Clark Hill LLP to be relieved as counsel for Defendant Countable Tech LLC c/o Global Virtual Agent Services, Inc. is GRANTED. (CRC 3.1362.)

The court will sign Counsel's proposed order. (MC-053.) Counsel must serve the signed order upon Defendant, and file proof of service with the court. The order will become effective upon filing of the proof of service. (CRC 3.1362(e).)

Defendant appears to be a corporation; a corporation must be represented by an attorney. CLD Construction, Inc. v. City of San Ramon (2004) 120 Cal.App.4th 1141, 1149-1150, holds that a pleading filed by an unrepresented corporation is not necessarily void or a nullity, but the Court should order the party to obtain counsel or, if not, it can strike its pleading. Defendant is advised that it cannot appear without counsel.

Counsel shall make a reasonable attempt to notify Defendant of the Court’s tentative ruling, including the order to appear, and the process for properly contesting by 4:00 p.m. one court day prior to the date of hearing.

HOW DO I CONTEST A TENTATIVE RULING?

Notify the Court and all the other parties no later than 4:00 p.m. (but by Noon if possible) at least one (1) court day before the scheduled hearing, and briefly identify the issues you wish to argue through the following steps: 1.
