DEFENDANT GOLDEN GATE FORTUNE COOKIES DEMURRER to COMPLAINT is SUSTAINED without leave to amend. Plaintiff's Three Day Notice to Pay Rent or Quit improperly demanded a sum of unpaid rent from prior than a year before the Notice's service, in violation of C.C.P. 1161(2). The Notice is therefore defective, and Plaintiff has failed to state a cause of action for unlawful detainer. =(501/DWH)
