Defendants' Demurrer to Complaint is SUSTAINED with leave to amend to allege facts supporting an exemption from the San Francisco Residential Rent Stabilization and Arbitration Ordinance.
The Three Day Notice to Pay Rent or Quit does not include the San Francisco Rent Board form required by section 37.9(c) of the San Francisco Residential Rent Stabilization and Arbitration Ordinance. This form is mandatory for eviction based on nonpayment of rent under section 37.9(a)(1) of the Ordinance. As the Complaint does not plead any basis for exemption from the Ordinance, plaintiff must comply with the local Ordinance as well as the California unlawful detainer statutes. =(501/CFH)
