DEFENDANT CHUNLEI LIU DEMURRER TO AMENDED COMPLAINT is OVERRULED. Defendant shall file and serve an answer within 5 days of service of a notice of entry of order.

The First Amended Complaint states facts sufficient to constitute a cause of action for unlawful detainer. The attached email from the defendant is allegedly evidence of the termination of the lease, which the plaintiff further alleges he agreed to. On demurrer, the plaintiff's well-pleaded allegations must be taken as true. To the extent the defendant disputes the plaintiff's factual allegations, those factual disputes are not grounds for demurrer. =(501/HEK)
