Petition to Compromise Plaintiff’s Disputed Claims

After reviewing the unopposed Petition filed by Lindsay Bowman, acting as guardian ad litem for disabled adult Plaintiff Jose de Jesus Gomez Carranza (“Plaintiff”), to compromise Plaintiff’s claims against Defendants Christina Hinz, M.D., and Cypress Coast Anesthesia Medical Group, Inc. (collectively, “Defendants”), the Court hereby CONDITIONALLY GRANTS the Petition. The Court requires confirmation from Defendants that they can pay the total settlement funds within 30 days of receiving the Court’s order. Defendants may confirm this at the hearing or by emailing the Court, with Plaintiff’s counsel copied.

Otherwise, the Court approves all other aspects of Plaintiff’s settlement, including the requested costs and fees, counsel’s handling of certain funds for the Medi-Cal lien, payment of the ERISA lien, the distribution of Plaintiff’s net settlement funds into a Special Needs Trust, and authorizes Ms. Bowman to execute releases and dismissals related to the Defendants’ settlement.

Assuming no party contests this Tentative Ruling and Defendants confirm prior to the hearing that they can pay the settlement funds within 30 days of the Court’s order, then no appearances are necessary, and the Court will complete and sign the Order accompanying the Petition.

NOTE RE TENTATIVE RULING

This tentative ruling becomes the court’s order, and no hearing shall be held unless one of the parties contests it by following Rule 3.1308 of the California Rules of Court and Monterey County Local Rule 7.9. Those parties wishing to present an oral argument must notify all other parties and the Court no later than 4:00 p.m. on the court day before the hearing; otherwise, NO ORAL ARGUMENT WILL BE PERMITTED, AND THE TENTATIVE RULING WILL BECOME THE ORDER OF THE COURT AND THE HEARING VACATED. You must notify the court by email or by calling the Calendar Department at 831-647-5800, extension 3040, before 4:00 p.m. on the court day before the hearing.
