MOTION FOR IMPOSITION OF SANCTIONS
Real Property/Housing Court Law and Motion Calendar for March 26, 2026. Line 8. PLAINTIFF DELAWARE LAKEWOOD APARTMENTS, LLC MOTION FOR IMPOSITION OF SANCTIONS is DENIED.
As reflected in the Court's previous ruling overruling Defendant's demurrer, the Court agreed that the demurrer was not meritorious. However, Plaintiff's argument that Defense counsel should have done more or better legal research into the applicable unlawful detainer statutes and case law before filing the demurrer does not make the demurrer a frivolous filing. Sanctions are therefore denied. Defense counsel is nonetheless admonished to ensure that all of her future filings adhere to the standards articulated in CCP 128.7(b). =(501/CFH)
