A waiver of account must be made by the trustees as such (not as beneficiaries). (Prob. Code, § 10954, subd. (b)(4).)
Subject to the foregoing, a final account will be waived.
The petition is missing the basis for computation of fees as set forth in California Rules of Court, rule 7.705(a) (i.e. receipts, gains, and losses). (Cal. Rules of Court, rule 7.705(b).) The fee calculation on pages 4-5 of the petition does not provide any information as to receipts, gains, and losses.
Subject to the foregoing, approve $23,301.39 in statutory fees each to Petitioner and her counsel. Approve the $1,200 in costs already paid and $1,040.90 in costs reimbursement to counsel.
The final distribution of the estate to the trustees of the Cottam Living Trust Dtd 12/29/16 is consistent with the terms of the will.
