Minute Order dated 03/06/25 ordered a Supplement to be filed and served on or before 03/06/25 by Attorney Ralston.

The Supplement was to provide who is entitled to notice, beneficiaries of the Raymond Bruno Trust dated 08/02/24, pursuant to Probate Code §1208 and that notice is sufficient or alternatively a statutorily sufficient Notice of Petition to Administer Estate (DE-121) (Probate Code §8110; §1208)

The Supplement has not been filed as of 05/19/26.

The court sets an OSC re Failure to Obey Court Order on 08/06/26 at 9:00 a.m. in Department J6.

The waivers are insufficient. Petitioner has attached the waivers of beneficiaries of the Raymond Bruno Trust dated 08/02/24. The beneficiaries of the trust is the trustee of the Raymand Bruno Trust dated 08/02/24. Probate Code §10954(b)(4) states, in pertinent part:

(b) A waiver or acknowledgment under subdivision (a) shall be executed as follows:

(4) If the person entitled to distribution is a trust, by the trustee, but only if the named trustee's written acceptance of the trust is filed with the court. In the case of a trust that is subject to the continuing jurisdiction of the court pursuant to Chapter 4 (commencing with Section 17300) of Part 5 of Division 9, the waiver or acknowledgment may be executed without the need to obtain approval of the court.

Petitioner to file a written acceptance of trust signed by the trustee, and a waiver of account signed by the trustee.

Petitioner has not provided all of the information required on waiver of account. Specifically petitioner has failed to provide information as to:

- Sales, purchases, or exchanges of assets - Changes in the form of assets - Assets on hand – petitioner states the value of the estate, but fails to state the assets. See CRC rule 7.550(b).

Petitioner to file and serve a verified supplement with the statutorily sufficient waiver of account and all information required on or before 07/24/26.

The court continues the hearing on the Petition for Final Distribution to 08/06/26 at 9:00 a.m. in Department J6.
