Hearing Required to address whether parties are willing to voluntarily vote on the issues subject to Section 3.3 of the CC&Rs; or either side is contemplating "compelling" a vote by any appropriate means.

Both sides to submit declarations no later than 9:00 a.m. no February 9, 2026 stating: (1) whether the declarant agrees to participate in a vote; the answer shall be limited to "yes" or "no"; (2) if the answer to question (1) is "yes," list the issues for the vote (limited to the issues listed in the complaint that are subject to Section 3.3); (3) if the answer to question (1) is "yes," provide the timeline required to conduct the vote, e.g. the vote can be conducted immediately; or the appropriate procedure requires preliminary steps to be taken, therefore the vote can take place the earliest on "date x;" and (4) if the party believes the vote may be compelled by any appropriate means, the time required to accomplish this, e.g. "party will take steps to compel the vote; the estimated time is 90 days." =(501/REQ)

Parties who intend to appear at the hearing must give notice to opposing parties and the court promptly, but no later than 4:00 p.m. the court day before the hearing unless the tentative ruling has specified that a hearing is required.

Notice of contesting a tentative ruling shall be provided by sending an email to the court to Department501ContestTR@sftc.org with a copy to all other parties stating, without argument, the portion(s) of the tentative ruling that the party contests.
