Plaintiff Liudmila Naumik's motion to compel defendant Andrea Augustin to provide further responses to special interrogatories, form interrogatories, requests for admission and requests for production of documents is denied as moot and her request for monetary sanctions is granted in small part. No later than August 14, 2026 Augustin must pay $1,060 in monetary sanctions to Naumik.
Augustin's service of supplemental responses to the great majority of discovery requests that Naumik sought supplemental responses moots this motion. If Naumik believes that the supplemental responses are deficient, she must engage in a code-compliant meet and confer with Augustin's counsel and, if any issues remain unresolved after the meet and confer, she may file another motion to compel.
Augustin's service of supplemental responses on the same day as her opposition papers is a tacit admission that her prior responses were not made in good faith and lacked substantial justification. As a self-represented litigant, sanctions awarded to Naumik are limited to $1,000 per CCP 2030.50 and her out of pocket costs. (Damak v. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
