Defendant Heng Liu's motion to compel responses to form and special interrogatories and requests for production is granted in part. Liu served the discovery on plaintiffs, who have not responded by the agreed extended deadline. Liu is entitled to objection-free responses. Plaintiffs Badarch Ochirsukh and Saruul Tseveendee are ordered to respond to the outstanding discovery within 20 days of entry of this order. (See Code Civ. Proc., section 2030.290, subd. (a); id., section 2031.300, subd. (a).)
Liu seeks sanctions. The opposition brief reveals that plaintiffs, who are based in Mongolia, have not responded to communications. By filing a lawsuit, a plaintiff takes on discovery obligations, and failure to maintain contact with counsel is not substantial justification for the lack of responses. (See Code Civ. Proc., section 2030.290, subd. (c); id., section 2031.300, subd. (c).) The court reduces the amount of sanctions in light of all the circumstances. Ochirsukh and Tseveendee are jointly and severally liable for $250 in sanctions to Liu. They are ordered to pay within 30 days of entry of this order.
