Defendant asserts that the Court's interpretation of the statutory language, as explained in the ruling is new information. Based on this new information, Defendant presents, for the first time, case law purportedly supporting his interpretation of what was missing from Plaintiff's Motion for Summary Judgment. None of these authorities are new, as they were all published prior to the filing of Defendant's original CCP 663 Motion. It was Defendant's burden to explain the legal and factual grounds for his original CCP 663 Motion.
Even considering Defendant's new arguments, none of the case law Defendant now cites stands for the proposition that a Plaintiff must affirmatively prove, as part of their prima facie case on a motion for summary judgment on a cause of action for unlawful detainer, compliance with each and every aspect of Civil Code 2924, where Defendant has not identified any asserted irregularity.=(501/CFH)
