Respondent filed a Request for Order (RFO) on February 19, 2026, seeking disqualification of Petitioner’s counsel. The request was originally set to be heard on May 14, 2026. Respondent filed a Proof of Service on May 12, 2026. It showed the RFO and Memorandum of Points and Authorities were served on Petitioner on May 1, 2026. However, it does not show that all of the required documents were properly served.
Parties appeared for a hearing on April 30, 2026, on a different RFO. At that time, the issues raised in the current RFO were raised. The court noted that there was no Proof of Service for the RFO. At the request of Respondent’s counsel, the court advanced the May 14th hearing and continued the matter to July 9, 2026.
Respondent filed a Memorandum of Points and Authorities, as well as four declarations regarding the request to remove Petitioner’s counsel on June 29, 2026. All were served on June 27th.
Petitioner has not filed a Responsive Declaration.
The court drops the matter from calendar due to the lack of proper service.
Petitioner’s counsel is advised to review the Rules of Professional Conduct.
