Gillibrand Family Trust dated July 10, 1970 as modified by the settlement agreements and order, the court has already determined the terms of the Decedents Trust on 05/08/01 and the terms of the trust do not include a power of appointment. Further William D. Fairfield, the predecessor co-Trustee of the Decedents Trust, abused his discretion in appointing Petitioner as successor trustee.
