As to the request that the court find that Celine L. Gillibrand had a testamentary limited power of appointment over the Decedent’s Trust under the terms of the Phillip W. Gillibrand Family Trust dated July 10, 1970 as modified by the settlement agreements and order, the court has already determined the terms of the Decedent’s Trust on 05/08/01 and the terms of the trust do not include a power of appointment. Further William D. Fairfield, the predecessor co-Trustee of the Decedent’s Trust, abused his discretion in appointing Petitioner as successor trustee.
