The following is a statement of the Courts tentative ruling. The Court may adopt, modify or reject the tentative ruling after hearing. The tentative ruling has no legal effect unless and until adopted by the Court.
Motion: Motion to Compel Arbitration (Unopposed)
Tentative Ruling: The Petition to Compel Arbitration is GRANTED. The Court finds a valid arbitration agreement exists. The Hon. Robert Polis is appointed as the neutral arbitrator to preside over the binding arbitration proceedings. The binding arbitration is to be completed within 180 days from the date of this order, or no later than January 4, 2027.
Petitioners request for attorneys fees is DENIED. There is no request for sanctions or attorney fees in the caption of the motion; the notice of motion does not specify the amount of attorney fees requested; nor does the motion specify the legal authority for the requested attorney fees.
A status conference re status of binding arbitration is set for January 20, 2027.
