Petition to Compel Arbitration

The petition to compel arbitration is GRANTED AND STAYED pending resolution of the non-arbitrable coverage issue.

Unless otherwise agreed to by the parties, the arbitrable issues under Insurance Code section 11580.2, subdivision (f) are the tortfeasor's liability to the insured, and the amount of damages. Exclusions to the policy fall outside of the arbitrable issues and must be determined by the court prior to arbitration.

The court sets the following briefing schedule regarding the coverage issue and Exclusion No.

5. Respondent is to file and serve their initial brief, with supporting documents and evidence, by September 11, 2026. Petitioner’s opposition is to be filed and served by September 25, 2026. The reply is to be filed and served by October 2, 2026.

The hearing regarding the coverage issue and Exclusion No. 5 is scheduled for October 14, 2026, at 8:15 a.m. in Courtroom 8.
