Tentative Ruling - 06/22/2026 Peter Borkon

ORDER RE: CASE MANAGEMENT AND ORDER TO SHOW CAUSE

The Court has ordered the following after review of the case.

On February 11, 2025, the Court issued a trial setting order that required the parties to pay jury fees within 30 days. They have not and appear to have waived their right to a jury trial. That same order required them to JOINTLY provide the Court with numerous documents by June 17, such as a neutral statement of the case, witness list, exhibit list and binders, motion in limine binders, jury instructions. The Court has not received any of these documents. Review of the record of action shows zero activity since the Initial Case Management Conference, counsel did not appear for the case management conference in March 2026.

Accordingly, the Court orders counsel for both sides to show cause why they should not be sanctioned $750 each for their failure to abide by the Court's pretrial/trial setting order, Local Rule 3.35 and the Rules of Court.

The Court sets this matter for an Order to Show Cause why sanctions should not be imposed for failure to comply with a Court Order. Order to Show Cause Re: Pretrial Compliance is set for 07/06/2026 at 02:30 PM in Department 15 at Rene C. Davidson Courthouse.

Failure to comply or appear may result in sanctions pursuant to one or more of the following: CRC 2.30, CRC 3.1340, CCP 177.5, CCP 575.2, CCP 583.150, CCP 583.360, CCP 583.410, CCP 583.420, CCP 583.430, and Government Code Section 68608.

The Court orders counsel to obtain a copy of this order from the eCourt portal.
